How can I or my member get a green card?

Permanent immigration is the ultimate goal of many people entering or planning to enter the United States. Lawful permanent residency offers individuals a multitude of benefits, including the freedom to live and work permanently in the U.S. Potential immigrants should be as informed about the laws as possible. Immigrants to the United States are divided into two categories:

  1. Individuals who may acquire permanent residency without numerical limitation.
  2. Individuals subject to a yearly limitation. There are three divisions of this category:

IMMIGRANT VISA

U.S. Employers may petition alien workers for lawful permanent residence. The alien can be either in the U.S. or at their country of nationality. The Petitions are processed according to the following preferences.

The First Preferences includes: Multinational Managers and Executives, Persons of Extraordinary Ability, Outstanding Professors and Researchers.

The Second Preferences include individuals holding Advanced Degrees or Aliens of Exceptional Ability. The majority of EB2 applicants must have a complete the labor certification processed and an offer of permanent employment.

Professionals, Skilled other Workers. The majority of EB3 applicants must have a complete the labor certification processed and an offer of permanent employment.

The EB4 category includes Religious Workers, Returning Residents and Ministers of religion, and Commuters from Border, Retired G-4 (Employee of international Organizations).

The Fifth Preferences is for individuals who invest a minimum of $500,000.00 into designated area and creates employment of specified number of employees. The designated areas include rural areas or areas of exceptionally high rate of unemployment.
